New York State Agency Disclosure — RPL §443

Pursuant to New York Real Property Law §443, before you provide us with any confidential information, you should understand that a real estate broker or salesperson who represents a buyer or tenant, a seller or landlord, or both parties in a real estate transaction must provide disclosure of the agency relationship.

DME REAL ESTATE SERVICES LLC will provide you with a written Agency Disclosure Form at or prior to the first substantive meeting regarding real property. We may act as:

  • Seller's Agent — representing the seller exclusively
  • Buyer's Agent — representing the buyer exclusively
  • Disclosed Dual Agent — representing both parties with informed written consent
  • Broker's Agent — working as subagent for another broker's principal

NYS RPL §442-H — Standard Operating Procedures

In accordance with New York Real Property Law §442-H and the regulations of the New York State Department of State (effective December 21, 2022), DME REAL ESTATE SERVICES LLC maintains written Standard Operating Procedures governing the intake of prospective homebuyers. These procedures address:

  • Identification requirements for prospective buyers prior to showing properties
  • Requirements regarding the use of a written buyer's representation agreement
  • Pre-approval documentation procedures

Current SOP Summary: DME REAL ESTATE SERVICES LLC may require prospective buyers to provide government-issued identification and a mortgage pre-approval letter or proof of funds prior to scheduling property showings. A written buyer representation agreement will be offered to all buyer clients.
